Terms & Conditions

1. Thomas Design & Graphics Limited (Here after referred to as TDG)
TDG’s registered office is at 30‐34 North Street, Hailsham, East Sussex, BN27 1DW. Our Company number is 0644 3434 our VAT registration number is 926 5004 39.

2. Price Variation

Prices are estimated and are based on our supplier costs and may be subject to amendment even after acceptance of quote or artwork should the supplier prices change or we deem it fit to improve the result of works.

3. VAT

TDG reserves the right to charge the amount of any Value Added Tax payable whether or not mentioned on the quote or invoice. Some promotional items are not subject to VAT, which will be deemed by HMRC, not by the client. Charities or Enterprises who are not VAT registered will not be exempt from VAT. Any VAT registered charities or Enterprises will need to reclaim VAT in their own book keeping affairs.

4. Free artwork

Free inclusive artwork refers to the initial layout only. All copy and images must be supplied electronically in an acceptable file format. We will not produce free copy or images on every occasion. We do not cover any image editing, logo design, copy writing or brochure layouts within the free initial layout offer. We may give some of these services on a discretionary basis. Any revisions after the free initial layout will be charged at our design rate – £75 per hour

5. Our artwork for approval

Any artwork received by a client must be read and checked for error thoroughly including contact details, we will not be responsible for any errors which have gone unnoticed by us or the client. Additional fees may be charged for revisions. If the client leaves the design to TDG and does not want to see artwork for approval we will not be held responsible for any errors. We will not accept your supplied artwork as a confirmation. Clients must confirm our version of their artwork for approval. All artwork must be approved in writing by way of email or letter otherwise TDG cannot be held responsible for any errors or price changes. These terms and conditions will be accepted by means of reply.

6. Copyright

Any artwork and layouts produced by TDG will remain the property of TDG unless consent is given to use the artwork. (Usually given on completition of works). When several options are given, the client is not permitted to use the alternatives which haven’t been selected for use. Any artwork or logos produced by TDG will not be submitted for any Copyrights, Trade Marking or IPR, it is down to the client to protect their brand. Any logos, copy or images submitted by the client is down the to the client and TDG will not be responsible for any breached copyright issues. Fonts, images or copy used in the layouts are either free or licensed and it will be down to the client to buy any additional licenses for their use.

Any images, Intellectual Property or copy used on TDG’s website & Social Media (www.signc.com) belongs to TDG and cannot be copied, replicated, or quoted without consent.  Page shares and reviews are permitted

7. Delivery & Payment

All products and services supplied by TDG must be paid for in advance or on delivery / completion. We do not offer any payment terms unless agreed in advance. Turnaround times are estimates and TDG will not be held accountable should a job be delayed. No orders carry a guaranteed turnaround time. Deposits are non‐refundable. Payment must be either credit / debit card, bank transfer, cash or paypal. Cheques are not generally accepted.

8. Claims

Damaged goods must be reported on delivery or installation, rectification after this point will be discretionary and subject to survey / inquiry. We do not accept returns unless the product is clearly faulty. This does not cover incorrect use which would not be refunded or rectified for free.

9. Liability

TDG offer no warranties or guarantees nor do we make any representations as to the merchantability or fitness for a particular purpose of any completed work, the subject of a customer’s order or any other warranties, conditions, guarantees or representations, whether express or implied, oral or in writing.

We cannot offer a guarantee or warranty on any of our products or services, nor will we be held liable for loss of business, profit, goodwill, data or time. After one year failed materials will be referred to the supplier or manufacturer. Rectifications will not be free or mandatory.

Installation of signs will have a one year guarantee as will vehicle liveries.  Anything else can be subject to incorrect use and cannot be guaranteed.

We recommend that any installed signs be surveyed every year due to storms / hurricanes, leaking water, rotting timber or insecure walls or carpentry made by third parties not affiliated with TDG.

10. Customer’s Property

Any type of property, physical or intellectual including vehicles are left at entirely the owners risk. Any work not collected within 30 days will be stored and charged for, any work stored after 6 months will be offered again for collection, failing that will be destroyed. Although debts will remain payable.

11. Materials Supplied by the Customer

Any materials supplied by the client cannot be guaranteed to work with our materials and will not be covered by our terms and conditions. We cannot be held responsible should the item be damaged or fail. We reserve the right to refuse to use customer or clients own materials.

12. Bankruptcy

TDG have the right to stop any ongoing works when a client becomes bankrupt and would not be liable for any problems caused to client by unfinished work.

13. Legal note

Should TDG consider any artwork, materials or content to be breaching any law we reserve the right to omit that part of the order, design, quote or installation

14. Colour & Resolution

All reasonable efforts shall be made to obtain the best possible colour reproduction of client’s requirements but we do not guarantee perfect reproduction of colours or resolution and changes to colour or resolution may be necessary due to the type of process used to produce the work or the proposed budget of the work.  RGB, CMYK process, Pantone, spot colour, RAL, type of media and daylight / artificial light can all affect how a colour is perceived.

16. Force Majeure

Where, in spite of its reasonable efforts, TDG is unable to perform obligations due to circumstances beyond their reasonable control, they shall not be deemed to be in breach of their contract with the Customer. Act of God, legislation, war, fire, flood, drought, failure of power supply, lock‐out, strike or other action taken by employees in contemplation or furtherance of a dispute.

17. Variation to Terms and Conditions

Latest amendments to these terms and conditions will be posted to our website rendering previous versions redundant.

18. Law

These terms and conditions and all other express terms of the contract with customers shall be governed and construed in accordance with English law. English Courts shall have jurisdiction in relation to any matters arising in connection with any contract between TDG and the customer into which these terms are incorporated.

TDG Declares all products and services do not present risks to health and safety if used in the correct manner.

19. Training

TDG may record inbound or outbound conversations for training purposes.  This is not currently procedure.

20. Trading names

TDG may advertise under different headings for promotional purposes.

21. Additional charging

TDG will charge a minimum charge for all separate phases of a job of at £20+vat. Any work required in less than 48 hours will be subject to a £20+vat or 10% cost of job additional charge which ever is greater.

Any jobs required in less than 24 hours will be quoted at a rate considered to cover what TDG deem to be compensation for stopping current works.

22. Logo and brand creation. Although every effort is made to create the desired brand any time spent will be charged for regardless if the client is satisfied with the result or not. Design is charged as labour and is payable as time spent as opposed to results achieved.

23. TDG has necessary Public Liabilty, Indemnity, Employee Liability insurances and its premises are insured internally. The grounds are insured by the landlord of the building.

24. TDG is not responsible for the removal of any graphics or signs applied and should we agree to remove graphics or signs they will be charged at our standard removal rate.  £100 per hour

25. TDG will suspend any projects or services should they deem a situation to be dangerous or illegal without consequence until the situation has been rectified or by‐passed and client will be charged for any loss of earnings at day rates.

26. Outsourced work

TDG will not be liable for files sent to third parties. The third party’s Terms and Conditions will apply once information is in their possession.  We would not send any personal information only the contact information in the advert or display

TDG will not be liable for work carried out by tradesmen or suppliers which we have referred

General Data Protection Regulation Compliance

We no longer keep customer’s address on file unless it is part of a design file.  If addresses have been sent by customer by email, the email may be stored on a secure Business Server (not a free version) as an archived email or in the secure cloud storage.  Customer’s name, phone number, email and production files will always be stored on a secure Business Server (not a free version).

We do not have a CRM nor do we hold any details in a database other than invoice records (stored on Secure Server).  Job-sheets are shredded after use and not stored unless job is live.

Customers details will not be shared on Social Media or our website with out express permission.  Any jobs showed on Social Media without consent will have Registration Plates and contact details blurred out.

We only obtain details from clients with permission.  We may take info from Companies House if we require a postal address to send jobs or information.

No paperwork or files on hardrives are kept after the job is complete.  Minimal details as outlined above will be kept on our secure servers.

We can remotely block or wipe any stolen computers or devices.  We monitor users and they have varying access with only the director have full access to secure files.  Staff have been alerted to the GDPR compliance and this update to our Terms and Conditions / Privacy Policy.  We can also remotely view where files have been accessed and by who or which device.

No financial details will be kept and all credit card receipts are kept in a locked box and destroyed after a short processing period.  We do not receive financial details in any other way than in person or by phone.

Client’s details are only used by TDG and will only be used to contact client directly or to use in design files for output if part of the job.

We do not collect any personal data, DOB, Sensitive data, biometric data, passwords, logins, financial data or identity information other than name, company name, phone number and email address.  Any data we hold is never taken off the server nor is shared at any point, EU, worldwide or otherwise.

Our privacy policy and T&Cs are reviewed every year along with our PCIDSS compliance policy.

Client’s details are not available to the public or other companies nor would they be sold or shared to marketing companies. TDG may introduce customers to individuals should we consider that their services maybe useful to a third party for gain of business to our client. (with permission)

If you have previously agreed to us storing your personal information for design or contact purposes, you may change your mind at any time by emailing us at info@signc.com, we will permanently delete your file or forward your file for inspection.

We will not sell, distribute or lease your personal information to third parties.

If you believe that any information we are holding on you is incorrect or incomplete, please email us as soon as possible, info@signc.com. We will promptly correct any information found to be incorrect

This privacy policy sets out how Thomas Design & Graphics uses and protects any information that you give us when you use this website.

Thomas Design & Graphics ensures that your privacy is protected. If ask you to provide certain information by which you can be identified when using this website, then you can be assured that it will only be used in accordance with this privacy statement.

What we do with it:

We do not share any information outside our company unless it is a production file for the job

We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect.   Every measure is taken to protect customers details with paid for and trusted cloud services (not free services) protected by passwords and only email address, name and phone numbers are stored.  Should our hardware be stolen we can remote wipe any files from that user/terminal.

How we use cookies:
